What kind of the contractual relationships between the parties arise if the package tour is purchased from the travel agent?
In this case, the trilateral relations arise between the Client, the Agency (SIA "De Mare Ad Mare Baltic") and the tour operators. Client represents all tour participants - tourists - and takes the responsibility to inform the tourists according to the contractual framework.
The contractual basis of these relations consists from the "General tourism and other tourism-related services terms and conditions" of the Agency and the contract between the Agency and the Client for the provision of tourism services.
What are the duties of Agency according to the contract?
The Agency provides the Client with information about the conditions of the tour, allows make the booking of the tour, sends to the Client booking confirmation or booking refusal, sends to the Client the necessary documents for the trip after receiving full payment.
The "General tourism and other tourism-related services terms and conditions" are the principal regulations, which establishe the rights, obligations and responsibilities of the Agency. These regulations have a priority in relation to the Agency in the event of conflict between the provisions of the terms and conditions as hereinbefore and those of the contract for the provision of tourism services.
What are the duties of tour operator according to the contract?
Tour operator ensures:
- the possibility for the Agency to exercise tours bookings on behalf of the Clients and information support necessary for the offer and sale of travel services to customers in accordance with the procedure and conditions established by the tour operator;
- organization of tourist trips and provision of tourist services in a volume specified in the contract and the document confirming the receipt of services.
The contract for the provision of tourism services between the Agency and the Client, as a rule, is concluded in accordance with the template set out by the tour operator. The contract as hereinbefore have a priority with respect to the rights, duties and responsibilities tour operator in the event of conflict between the provisions of the contract and the "General tourism and other tourism-related services terms and conditions" of the Agency.
How the contract for the package tour is concluded?
When you use this website and on-line service offered throught it, you are binding and you agree to comply with the "General tourism and other tourism-related services terms and conditions" of the Agency.
When you submit to the Agency an application for booking of the tour on-line on the website www.demareadmare.lv or www.demareadmare.eu, you need to check a checkbox with the text "agree with the terms of the contract." From this moment the "General tourism and other tourism-related services terms and conditions" of the Agency are binding for you as well as other additional documents indicated in the application form, if applicable.
After the tour operator confirms the booking, an email will be sent to your email address with a link for payment and the accompanying agreement between you and the Agency for the provision of tourist services, which specifies the details of the trip. You need to pass on this link in the email to the website and check a checkbox with the text "agree with the terms of the contract", which makes the terms of the contract for provision of tourism services legally binding for you.
The "General tourism and other tourism-related services terms and conditions" provides other forms of conclusion of the contract, which you can choose, if you wish.
What are the requirements for me imposed by the legislation?
Cabinet's of Ministers of the Republic of Latvia Regulations No353 imposes the following requirements to you:
- to observe the requirements specified for a person in the regulatory enactments regarding the procedures for crossing borders;
- to arrive at the time and place specified in the contract, as well as observe the provisions for the use of hotels, means of transport and other services;
- to communicate any failure during the performance of the service, without delay in writing or in some other acceptable form to the tourism operator or the representative thereof;
- to inform without delay the representative of the tourism operator specified in the contract, if the client intends not to join the group during the provision of the service; and
- to ensure that while travelling the contract entered into regarding the provision of the service, which serves as evidence of commitments, is available.
